These Terms of Service ("Terms") govern your use of the virtual personal training services provided by biennisprf B.V. ("Company," "we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms.

Acceptance of Terms

By registering for, accessing, or using our virtual personal training services, website, or mobile application, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these terms, you must not use our services. These terms constitute a legally binding agreement between you and biennisprf B.V.

Service Description

biennisprf provides virtual personal training services, including one-on-one training sessions, group fitness classes, nutrition coaching, and related wellness services delivered through video conferencing technology. Our services are designed to help clients achieve their fitness and health goals through professional guidance and support.

User Eligibility and Responsibilities

You must be at least 18 years old to use our services independently. Users between 16-18 years old may use our services with parental consent. You are responsible for providing accurate information about your health status, fitness level, and any medical conditions that may affect your ability to exercise safely. You must follow all instructions provided by our trainers and exercise within your physical capabilities.

Health and Safety Disclaimer

Our virtual training services are not a substitute for professional medical advice. You should consult with a healthcare provider before beginning any exercise program, especially if you have pre-existing health conditions. You participate in our training sessions at your own risk and acknowledge that physical exercise involves inherent risks of injury. biennisprf and its trainers are not liable for any injuries that may occur during or as a result of participating in our services.

Booking and Cancellation Policy

Training sessions must be booked in advance through our platform or by contacting us directly. You may cancel or reschedule sessions with at least 24 hours notice without penalty. Cancellations made less than 24 hours before a scheduled session may result in a charge for the full session fee, except in cases of emergency or illness. No-shows will be charged the full session fee.

Payment Terms

Payment is required before services are rendered unless otherwise agreed in writing. We accept various payment methods as specified on our platform. All prices are in Euros (EUR) and include applicable VAT. Refunds are provided in accordance with our refund policy and applicable consumer protection laws.

Intellectual Property

All content provided through our services, including workout plans, training materials, videos, and educational content, is the intellectual property of biennisprf B.V. and is protected by copyright and other intellectual property laws. You may use this content solely for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

User Conduct

You agree to use our services in a respectful and appropriate manner. You must not engage in any behavior that is harmful, offensive, or disruptive to other users or our trainers. You are prohibited from recording, photographing, or otherwise capturing our training sessions without explicit permission. Any violation of these conduct rules may result in immediate termination of services.

Privacy and Data Protection

We are committed to protecting your privacy and personal data in accordance with GDPR and applicable data protection laws. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, biennisprf B.V., its directors, employees, and trainers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services. This includes, but is not limited to, damages for personal injury, loss of profits, or loss of data. Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Technology Requirements

You are responsible for ensuring you have the necessary technology and internet connection to participate in virtual training sessions. This includes a device with camera and microphone capabilities, stable internet connection, and appropriate software. We are not responsible for technical issues that prevent you from accessing our services, though we will make reasonable efforts to assist you.

Termination

Either party may terminate the service agreement with reasonable notice. We reserve the right to immediately terminate or suspend your access to our services if you violate these Terms or engage in conduct that we deem harmful to our business or other users. Upon termination, you must cease all use of our services and return or destroy any materials provided to you. Termination does not relieve you of any payment obligations incurred prior to termination.

Modifications to Terms

We reserve the right to modify these Terms at any time by posting updated Terms on our website. Material changes will be communicated to you via email or through our platform. Your continued use of our services after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of our services.

Force Majeure

We shall not be liable for any failure or delay in performance of our services due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or technical failures of third-party systems.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands. If you are a consumer resident in the EU, you may also have the right to bring proceedings in the courts of your country of residence.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms agreed to in writing, constitute the entire agreement between you and biennisprf B.V. regarding your use of our services and supersede all prior or contemporaneous communications and proposals.
